Mediation
Mediation is a way to settle a dispute before taking it to court, or can be used to resolve cases that have been filed in court. Mediation is usually less expensive and less stressful than court. Mediation is respectful, private and fair to both parties. The outcome is determined by the parties, rather than by a judge or jury. This known outcome is often easier to accept than a surprise ruling from a judge or verdict from a jury.
If you want to remain on good terms with the other person, you may want mediation rather than court.
If you want confidentiality, most things disclosed in mediation cannot be disclosed, even in court. By contrast, in court proceedings, most things are subject to disclosure.
In mediation, there is opportunity for the parties to craft a resolution that is mutually agreeable and a creative, workable solution, rather than to engage in litigation tactics that may permanently harm the parties’ relationship. A good mediator is a good listener. She encourages the parties to identify the outcome they desire, provides them feedback about their challenges and helps them solve the problem themselves.
When agreement is reached in mediation, people are more likely to follow through with the agreement. This is particularly helpful in family law matters, where parenting time, joint parenting and child support issues may be an ongoing concern for many years to come.
